TeESH Terms of Service
Clear marketplace rules for buyers, professional sellers and the digital gaming ecosystem. Understand your rights, responsibilities and the framework governing your use of TeESH.
TeESH Terms of Service & Marketplace Terms
These Terms of Service and Marketplace Terms (“Terms”) govern access to and use of TeESH, including its website, marketplace, accounts, checkout, digital-product functionality, order services and related features (collectively, the “Platform”).
By creating an account, accessing the Platform, listing or offering a product, placing an order, or otherwise using TeESH, you agree to these Terms and to any policies expressly incorporated into them.
If you do not agree to these Terms, you must not use the Platform.
About TeESH
TeESH operates a digital gaming marketplace designed to connect individual buyers with eligible businesses that may include professional sellers, resellers, distributors, publishers and developers.
Unless TeESH expressly identifies itself as the direct seller of a particular product, TeESH acts as a marketplace intermediary and technology platform facilitating discovery, transactions, order processing and digital fulfillment between marketplace participants.
The identity of the seller applicable to a transaction may be displayed in the relevant product, checkout or order information.
Nothing on the Platform should be interpreted as stating that TeESH develops, manufactures, publishes or owns third-party video games or other third-party products.
Eligibility
You may use TeESH only if you are legally capable of entering into a binding agreement under the laws applicable to you.
If you are under the age of legal majority in your jurisdiction, you may use the Platform only with the authorization and supervision required by applicable law.
Certain products may be subject to age, geographic, platform, publisher or other eligibility restrictions.
Accounts
Users must provide accurate, current and complete information when creating or maintaining an account.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account to the extent permitted by applicable law.
You must promptly notify TeESH if you reasonably believe your account has been accessed or used without authorization.
TeESH may require identity, contact, business, payment, fraud prevention or other verification where reasonably necessary for marketplace security, legal compliance or risk management.
Individual and Professional Accounts
TeESH may provide different account capabilities for individual users and professional businesses.
Professional marketplace participants may be required to provide business information and satisfy TeESH onboarding, verification, compliance and account-approval requirements.
Approval of a professional account by TeESH means only that the account has satisfied TeESH's applicable marketplace onboarding requirements at that time. It does not, by itself, mean that the business is endorsed, certified or authorized by a game publisher, manufacturer, platform operator or other third party.
Seller Responsibilities
Each seller is responsible for the accuracy and legality of its offers and for having all rights, licenses, authorizations and permissions necessary to sell or distribute the products it offers.
Sellers must not offer counterfeit, stolen, fraudulently obtained, unlawfully distributed, previously redeemed, invalid or otherwise unauthorized digital products.
Sellers are responsible for product descriptions, restrictions, regional limitations and other seller-supplied information, subject to TeESH marketplace controls and applicable law.
TeESH may request evidence concerning product origin, distribution rights or other information reasonably necessary to protect buyers, rights holders or the Platform.
Marketplace Listings and Product Information
Product availability, prices, promotions, supported platforms, regions and other offer characteristics may vary.
TeESH may organize, format or display marketplace information to facilitate comparison and discovery.
A product's publisher, developer, manufacturer, platform operator and seller may be different entities.
References to third-party brands, games and platforms are descriptive and do not imply sponsorship, endorsement or partnership unless expressly stated.
Orders
Submitting an order does not necessarily mean that the order has been finally accepted or fulfilled.
Orders may be subject to payment confirmation, fraud screening, product availability, seller validation, geographic restrictions and other marketplace controls.
TeESH may reject, cancel, hold or review an order where reasonably necessary to address suspected fraud, payment problems, pricing or technical errors, legal requirements, product unavailability or marketplace abuse.
Prices, Fees and Taxes
The price and any applicable fees presented during checkout form part of the transaction information.
Prices may change before an order is completed.
Applicable taxes, currency-conversion charges or payment-provider charges may depend on the transaction, location and payment method.
Nothing in these Terms guarantees that a product offered on TeESH will be the lowest-priced product available in the market.
Payments
Payments may be processed using third-party payment providers.
Use of a payment method may also be governed by the terms of the applicable payment provider or financial institution.
A payment initiation, authorization or notification does not necessarily constitute final payment confirmation.
TeESH may use payment-state verification and other transaction controls before allowing an order to proceed to paid fulfillment.
Digital Products and Fulfillment
Digital products may include game keys, activation codes, gift cards, subscriptions, licenses, digital entitlements or other electronically delivered products.
Fulfillment may be subject to successful payment verification, availability and applicable marketplace controls.
Delivery times displayed by TeESH are estimates unless a specific legally binding commitment is expressly stated.
Buyers are responsible for reviewing applicable platform, region, device, account and activation requirements before purchase.
Digital Licenses
Unless expressly stated otherwise, purchasing a digital product does not transfer ownership of the underlying copyright, trademark, software or intellectual property.
Digital products may instead provide a license or right of access governed by the applicable publisher, platform, developer or rights holder.
Users must comply with applicable third-party license and platform conditions.
Refunds, Cancellations and Disputes
Refund and cancellation eligibility may depend on the product, seller, whether a digital code or entitlement has been disclosed, accessed, activated or redeemed, and applicable law.
Any TeESH refund policy or seller-specific terms presented during the transaction form part of the applicable purchase conditions.
Nothing in these Terms eliminates any refund, cancellation, chargeback or consumer right that cannot lawfully be waived.
Users should contact TeESH through the available support channels promptly if they believe an order was unauthorized, incorrect, invalid or not delivered as represented.
Chargebacks and Payment Disputes
Users must not knowingly initiate fraudulent or abusive chargebacks.
TeESH may provide transaction records and relevant evidence to payment providers, financial institutions or competent authorities when reasonably necessary to respond to a payment dispute or suspected fraud.
Account access may be restricted while a material payment dispute, suspected fraud or abuse investigation is pending, to the extent permitted by law.
Marketplace Security
TeESH uses transaction, account and fulfillment controls designed to reduce marketplace risk.
No website, marketplace, payment system or electronic delivery mechanism can guarantee absolute security or eliminate every form of fraud, unauthorized access, technical failure or malicious activity.
Users must not attempt to bypass security controls, obtain unauthorized access, interfere with the Platform, manipulate transactions or misuse digital products.
Prohibited Conduct
You may not use TeESH to:
- violate applicable law or regulation;
- commit or facilitate fraud;
- sell counterfeit, stolen or unauthorized products;
- infringe intellectual-property rights;
- circumvent payment or marketplace controls;
- interfere with Platform security or availability;
- misrepresent your identity or business status;
- launder money or conceal unlawful proceeds;
- evade sanctions or legally applicable trade restrictions;
- harass, threaten or unlawfully harm another person; or
- use automated systems in a manner that materially disrupts the Platform.
Fraud Prevention and Compliance
TeESH may monitor transactions and account activity for fraud prevention, security, legal compliance and marketplace integrity.
Where legally permitted or required, TeESH may request additional information, restrict transactions, suspend accounts, preserve records or cooperate with payment providers and competent authorities.
Sanctions, Export Controls and Geographic Restrictions
Users are responsible for complying with trade sanctions, export-control laws and other geographic restrictions applicable to them and their transactions.
TeESH may restrict access to products, payments or Platform features where reasonably necessary to comply with applicable legal requirements or third-party product restrictions.
Intellectual Property
The TeESH name, original Platform design, original content and other TeESH-owned materials are protected by applicable intellectual-property laws.
Third-party trademarks, game names, logos, artwork and other materials remain the property of their respective owners.
Users and sellers must not upload or distribute material through TeESH unless they have the rights necessary to do so.
Intellectual-Property Complaints
TeESH may remove or restrict content or offers that are reasonably alleged to infringe intellectual-property rights.
Rights holders may contact TeESH using the designated contact or reporting mechanisms and should provide sufficient information to identify the protected work, challenged material and basis of the complaint.
Third-Party Services
The Platform may interact with third-party payment processors, publishers, platforms, sellers, service providers or external websites.
TeESH does not control every third-party service and is not responsible for third-party acts, omissions, outages, policies or content except to the extent responsibility cannot legally be excluded.
Platform Availability
TeESH may modify, maintain, suspend or discontinue Platform features where reasonably necessary.
The Platform may occasionally be unavailable because of maintenance, infrastructure failures, cybersecurity events, third-party outages or circumstances beyond reasonable control.
TeESH does not guarantee uninterrupted or error-free operation.
Account Suspension and Termination
TeESH may restrict, suspend or terminate an account where reasonably necessary because of suspected fraud, security risk, material breach of these Terms, legal requirements, payment abuse, intellectual-property violations or conduct that threatens the Platform or other users.
Where appropriate and legally required, applicable notice or review rights will be provided.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEESH DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED BY TEESH, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
TEESH DOES NOT WARRANT THAT EVERY THIRD-PARTY PRODUCT, SELLER, SERVICE, PLATFORM OR EXTERNAL SYSTEM WILL ALWAYS BE AVAILABLE, ERROR-FREE OR SUITABLE FOR EVERY USER.
NOTHING IN THIS SECTION EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEESH AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY OR GOODWILL, ARISING FROM OR RELATING TO THE PLATFORM OR THESE TERMS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEESH WILL NOT BE RESPONSIBLE FOR LOSSES CAUSED SOLELY BY A THIRD-PARTY SELLER, PUBLISHER, PLATFORM, PAYMENT PROVIDER, NETWORK, USER OR OTHER THIRD PARTY OUTSIDE TEESH'S REASONABLE CONTROL.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEESH'S AGGREGATE LIABILITY ARISING FROM A PARTICULAR TRANSACTION WILL NOT EXCEED THE GREATER OF THE AMOUNT ACTUALLY PAID TO TEESH IN CONNECTION WITH THE TRANSACTION GIVING RISE TO THE CLAIM OR USD $100.
THE LIMITATIONS ABOVE DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING WHERE APPLICABLE LIABILITY ARISING FROM FRAUD, WILLFUL MISCONDUCT OR OTHER NON-WAIVABLE STATUTORY RIGHTS.
Indemnification
To the extent permitted by applicable law, professional sellers and business users agree to defend, indemnify and hold harmless TeESH and its affiliates, officers, directors, employees and agents from third-party claims, damages, liabilities, penalties and reasonable legal expenses arising from their unlawful products, infringement of third-party rights, fraud, material breach of these Terms or violation of applicable law.
This provision does not require a consumer to waive non-waivable rights or remedies.
Consumer Rights
These Terms do not waive rights granted to consumers that cannot legally be waived by contract.
If mandatory consumer-protection law in your jurisdiction provides greater protection than these Terms, the mandatory law applies to the extent of the conflict.
United States Users
Users located in the United States may have rights under federal and state consumer-protection, payment, privacy and other applicable laws.
Nothing in these Terms is intended to exclude or restrict a right or remedy that applicable United States law does not permit the parties to waive.
International Users
TeESH may be accessible from multiple jurisdictions. Availability of the Platform does not mean every product, seller or feature is legally available in every country.
Users and sellers remain responsible for laws applicable to their activities, subject to obligations imposed directly on TeESH by applicable law.
High-Volume and Regulated Sellers
Where applicable law requires marketplace operators to collect, verify, maintain or disclose seller information, TeESH may require affected sellers to provide the necessary information and keep it accurate and current.
TeESH may restrict or suspend affected seller activity when required information is not supplied or cannot be satisfactorily verified, to the extent required or permitted by applicable law.
Privacy and Data
Personal information is handled in accordance with TeESH's applicable privacy notices and data-protection obligations.
Information may also be processed where reasonably necessary for transactions, fraud prevention, security, legal compliance, dispute handling and marketplace operation, subject to applicable law.
Changes to These Terms
TeESH may update these Terms to reflect changes in the Platform, marketplace model, security requirements, commercial practices or applicable law.
Material changes will take effect in accordance with applicable notice and consent requirements.
The effective date displayed at the beginning of these Terms identifies the current version.
Governing Law
These Terms are governed by the law validly designated by the TeESH operating entity, subject to mandatory consumer-protection and conflict-of-law rules that apply to the user.
Until TeESH publishes a specific governing-law and forum designation associated with its operating legal entity, nothing in this section should be interpreted as selecting a jurisdiction that has not been formally designated.
Dispute Resolution
Before initiating formal proceedings, users are encouraged to contact TeESH and provide sufficient information to allow the dispute to be reviewed.
Any mandatory jurisdiction, consumer dispute-resolution or statutory rights applicable to a user remain unaffected.
TeESH may adopt additional dispute-resolution procedures in the future where legally appropriate, with any required notice or consent.
Force Majeure
To the extent permitted by applicable law, TeESH will not be liable for delay or failure caused by events beyond its reasonable control, including major network outages, infrastructure failures, natural disasters, war, civil disturbance, governmental action, widespread cyber incidents or failures of essential third-party infrastructure.
Severability
If any provision of these Terms is determined to be unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, and the remaining provisions will continue in effect.
No Waiver
A failure by TeESH to enforce a provision of these Terms on one occasion does not constitute a waiver of the right to enforce that provision or another provision later.
Entire Agreement
These Terms, together with policies and transaction-specific conditions expressly incorporated into them, constitute the agreement governing use of the Platform concerning the subjects addressed here.
Contact and Legal Notices
Questions, marketplace complaints and legal notices should be submitted through the contact mechanisms officially published by TeESH.
Additional legal-entity, registered-address and formal notice information may be published when applicable to the TeESH operating entity.
Final Legal Reservation
Nothing in these Terms is intended to exclude, restrict or modify any liability, warranty, consumer protection, statutory remedy or other legal right where doing so would be prohibited by applicable law.
Clear rules. Better marketplace experiences.
These Terms form part of the framework supporting interactions between individual buyers, professional gaming businesses and TeESH.
